What to Exepect at the Hearing

WHAT TO EXPECT WHEN YOU ATTEND YOUR HEARING

This is a brief description of what will take place at the actual hearing. We trust it will help the complainant and respondent to know what to expect upon their arrival for the actual hearing. When you arrive at the Board Office, you will be greeted by staff. All parties will wait in the office until all are called into the hearing room.

HEARING STARTS PROMPTLY: You will be called into the hearing room.

CHAIR PERSON'S OPENING STATEMENT AND CONDUCT OF HEARING: The Chairperson will begin the hearing.

SWEARING: All persons will be sworn in. Witnesses will then leave the room until they are called to testify.

OUTLINE OF PROCEDURE FOR HEARING: The chairperson will go over the procedures.

PRESENTATION BY COMPLAINANT: You or your attorney (if you have one) will verbally present your case to the panel. You will call your witnesses (if any) to testify in your behalf.

CROSS EXAMINATION BY RESPONDENT: The respondent will now have an opportunity to ask the you questions regarding your presentation and also ask questions if any of your witnesses

QUESTIONS FROM PANEL MEMBERS: The panel members will now have an opportunity to ask you questions regarding your presentation and also ask questions if any of your witnesses.

PRESENTATION BY RESPONDENT: The respondent will now present their case to the panel. They will call their witnesses if any.

CROSS EXAMINATION BY COMPLAINANT: The complainant will now be able to ask questions of the respondent and the respondent’s witnesses.

QUESTIONS FROM PANEL MEMBERS: The panel will now be able to ask questions of the respondent and the respondent’s witnesses.

CLOSING STATEMENT BY COMPLAINANT: You will now be able to make your final verbal closing statement to the panel.

CLOSING STATEMENT BY RESPONDENT: You will now be able to make your final verbal closing statement to the panel.

CONFIDENTIAL NATURE OF THE HEARING: The hearing is confidential and should not be discussed.

ADJOURNMENT: All parties will leave.

PROCEEDING FOLLOWING HEARING - EXECUTIVE SESSION: The panel then meets to come to the conclusions. Each party may elect to come to the Board Office and pick up the panel’s decision, which is usually rendered by the end of the day, or they can elect to have it sent via certified postal mail. If the conclusion is to be physically picked up, it must be signed for.
